Obligations of service providers
Information which the service provider is obliged to make avaliable to the service recipients:
- their name, legal status, legal and organizational form, registered office and contact details for quick and immediate communication;
- their registration in a commercial or other public register, name of the register, registration number or equivalent means of identification;
- their licensing regime, if the activity is subject to such;
- their VAT ID number;
- the professional organization, in which the service provider is registered;
- the terms and conditions of use of the service, if any;
- the existence of contractual clauses concerning the law applicable to the contract and/or the competent courts or arbitration institutions;
- after-sales guarantee that is not imposed by law, if any;
- the price of service when such is pre-determined by the provider for a given service;
- the main characteristics of the service, if not obvious;
- information about professional liability insurance and guarantees;
- other information.
Information which the service provider is obliged to make avalible at the service recipient's request:
- the price of the service if it is not fixed in advance or information on the method for calculating the price or a sufficiently detailed estimate;
- the professional rules applicable in the Member State of establishment and how to access them, in respect of regulated professions;
- other services rendered and partnerships that are directly related to the service provider, and the measures taken to avoid conflicts of interest;
- codes of conduct to which the provider is subject and the web address at which these codes may be consulted by electronic means;
- access to out-of-court means of dispute resolution, regulated by a code of conduct or by a trade association or professional organization whose member the provider is.
